True Story: Can’t We Call Just Get Along?
In 1985, I was but a struggling young pup in the real estate business. One morning I was at the old Home Savings (now Washington Mutual) on Garnet at East Mission Bay Drive. Homebuying Question


"I bought my home in Chula Vista directly from the owner. When it rained a few weeks ago, the roof leaked and caused a lot of damage. I had a roofer out and he told me I need a new roof and it’ll cost me $6,000. Altogether I’ll be out $7,700. I was talking with my neighbor and he told me the seller had roof leaks but painted over the stains because he didn’t want to pay for a few roof. How do I get the seller to reimburse me for my loss?"

***ANSWER:
I’m sorry to hear about your situation. Since I'm not an attorney, I must advise you to seek legal counsel. Here is my real estate agent’s opinion...

Go find and read the "Real Estate Transfer Disclosure Statement" (TDS) to see if the seller disclosed the roof problem. I’m guessing they didn’t since they painted over the leaks. If they did disclose it to you, you were put on notice and probably have no case. (NOTE: since you bought directly from the owner, it’s very possible things weren’t done correctly and you may have never received the TDS.)

If it wasn’t disclosed, the seller is liable for damages. See what your attorney says...
 

 

HomeSELLING Question


"Hi Gary. When I refinanced my condo last October, I took out a large loan to pay off some debts. Now I just got laid off and can’t pay my mortgage. What’s worse is I can’t sell because I owe $495,000 and it’s only worth $475,000. I’m stuck and I don’t know what to do. Can you help me?"

***ANSWER:
You may be a perfect candidate for something called a “short sale”, “short pay”, or “short pay-off”.

A “short sale” occurs when someone owes too much to sell and pay the normal closing costs, broker fees, and loan balance, and the lender agrees to accept less than the full balance on the mortgage.

Lenders will often agree to a short sale if certain conditions are met. Some of the conditions are:

A) inability to pay the mortgage
B) a valid “hardship” or negative event that caused that inability
C) insufficient cash to pay the shortfall
D) sales price at or close to market value

A short sale is a complex process and should NOT be attempted by an inexperienced agent. In the down market of the early/mid 1990’s, I obtained successful short sale for about 200 clients.

Investing or Financing Question
"My wife and I currently own a 3-bedroom condo in Mission Valley and we really want a house with a nice yard and a garage. Our condo should sell for about $425,000 now, netting us $210,000. How much house can we afford to buy?"

***ANSWER:
Down payment is but one factor in determining the maximum home price you qualify for. Others are your credit score and possibly your income (there are loans where lenders don’t care about your income.).

And of course, another big factor is what payment you're comfortable with.
