Before I’d Work Like This
One of my bank contacts shared two shocking stories about selling their Detroit
foreclosures. Story #1: When his top foreclosure agent goes to their properties
in the worst areas, he drives an ARMORED Chevy Suburban, escorted by two
bodyguards armed with automatic weapons! My contact said when flew into town to
view the bank’s properties, the agent blockaded the 100% vacant street with a
Suburban and armed guards at each end. …Sounds more like Baghdad than the U.S.
(Story #2 next week.)

Homebuying Question
"Hi Gary. We just found the
perfect house and it’s at a great price. Even though we both agree it’s priced
right, my husband wants to offer quite a bit under the asking price. What’s the
downside to making a low offer?”
***ANSWER:
(Part 4 of a 4-part answer)
Who determines “value”?
The market does. And you and I do.
I define value as “the price a willing, informed buyer and seller would agree on
in an arm’s length transaction”.
In practice, you and I determine what we believe market value is by seeing homes
and educating ourselves. We look at homes that have sold and homes that aren’t
selling.
With time, we develop a gut for what a home’s approximate value is. Of course,
my gut has probably been doing this longer than yours has, so feel free to ask
me my opinion.
So the best approach to knowing value is twofold: 1) educate yourself, and 2)
work with a skilled Realtor you know and trust to advise you.
HomeSELLING Question
"I’ve heard that if I sell my home and then
change my mind, I can rescind the contract and cancel. How long is my right of
rescission? Isn’t it 3 days?”
***ANSWER:
Real estate contracts offer no right of rescission for either party.
While not a right of rescission, the buyer of a property usually has specific
contingencies that allow cancellation w/o penalty for a limited period. That’s
because as a buyer they’re coming into an unknown and are given time to arrange
financing, inspect and investigate the home, etc.
Under the standard contract, as a seller you can only cancel if the buyer
doesn’t perform.
NOTE: When I represent a client selling a property, I negotiate the right to
cancel if the buyer does not appear qualified. Incredibly, the standard contract
gives such a weak, watered-down right that it can rarely be exercised.
Investing or Financing Question
"I’m a veteran from the first
Gulf War. I know for awhile that it was almost impossible to use my VA to get a
loan to buy a home in San Diego. Has that changed? "
***ANSWER:
I want to first say, THANK YOU for your service to our country.
In answer to your question, for many years it’s been hard to buy VA here in San
Diego. That was for two reasons:
First, VA loans cost the seller about $3,000 in extra fees. So when homesellers
were all getting multiple offers, asking for VA financing usually meant your
offer was rejected.
Secondly, VA loan limits have been too low to purchase most homes in San Diego.
Now with sellers more motivated, prices softer, and zero-down VA loans up to
$417,000 (higher if you put $$ down), you should be able to use your VA loan.
BUT…Would you even want to?
