True Story: Valentines Day Shocker
WARNING: This one’s a little edgy. My apologies in advance…
We handle foreclosed properties (called “REOs”) for several major banks. On Valentine’s Day, my main REO assistant was at a house negotiating with the ex-owner, a woman, to move out. She excused herself to find some papers. When the attractive blonde woman returned, she was wearing a see-through negligee and said, “How about I give you a little Valentine’s Day gift and you let us stay an extra three months?” Shocked, my assistant graciously declined and made his way out of the house.

HomeBUYING Question


"With this buyer’s market, I’m dying to finally buy a home, but my work schedule is crazy and I’m constantly out of town on business. What things require me to be here?"

***ANSWER:
You can do absolutely everything long distance, via phone, fax, email, and FED-X.

But I strongly recommend you show up live to actually look at homes (which I bet you were planning to do) and for your home inspection.

On the inspection, there’s a difference between reading a report versus seeing with your own eyes what the inspector finds and asking the inspector questions on site and seeing the answers.

 


HomeSELLING Question


"Hi Gary. We’re trying to choose an agent to sell our home in UTC. One of them suggested a higher price, but I’ve never heard of his company. The other is with XXXX [a large firm], so he’s probably pretty good. Who do you think we should go with?”

***ANSWER (Part 1 of 3):
First, let me remind you that I’m a full-time Realtor myself and would be happy to help you. That being said, let’s start off by having you take this quick quiz:

Which is the best way to choose your agent?

Y / N 1. Suggested highest price
Y / N 2. Most likeable
Y / N 3. Lowest fee
Y / N 4. Best presentation
Y / N 5. Is a friend
Y / N 6. Works for known firm
Y / N 7. Works at a big office nearby
Y / N 8. Was referred
Y / N 9. Isn’t too busy
Y / N 10. Sitting at your kitchen table at the right time

Answer: None of the above.

None of them give you even the smallest clue about the agent’s skills or track record.

The worst agent on earth could suggest the highest price, be likeable, charge less, present well, be a friend, work for a known firm or big office nearby, be referred, have lots of time on their hands, and/or show up at the right time.

Number 8 could carry some weight if the referring party actually used the agent, though that may reflect their performance in only one transaction.

So how DO you choose an agent to sell your home? There’s one, and only one, way…

The agent’s PERSONAL track record of success.

Not the national firm’s, not the local office’s, but HIS or HER own track record.

Investing or Financing Question


"We just bought a fixer-upper house to fix and flip. The repair work is about done. We want to sell it and buy another and not loose a lot of $$ to the taxman. Can we do one of those 1031 exchanges so we don’t pay no taxes?"

***ANSWER:
Two excellent real estate agents that used to work for me bought a fixer-upper house a few years ago. They told me they were going to “1031” the money into another house and do the same thing.

Unfortunately, I had to break the bad news.

To be eligible for a 1031 tax-deferred exchange, The IRS says a property must be “held for investment, business, or use in a trade”.

That means it can’t be held for resale. The IRS says that makes you a real estate “dealer” and you’re not eligible for a 1031 exchange.

To be eligible, you’d have to intend to rent the property out. And the best way to show that intent is to actually rent it out, for a good year or more.

So, I’m sorry to tell you I don’t think you can do an exchange on your fix and flip house.
