True Story: The Big House
We were sitting in the woman’s living room, discussing selling her home. Suddenly she looked past me, over my shoulder and out the window, and exclaimed, “That might be my husband. He’s getting out of prison today and he swore he was going to off me when he got out.” (Memo: “off” as in “knock off”). For reasons I’ll never know, I did not high tail out the back door and hop the fence. Instead, I foolishly hung in there and she signed the papers. Interestingly enough, the husband did NOT “off” her. In fact, he signed the papers a few days later…and actually turned out to be one heck of a nice guy. Go figure. (Like last week, once again I escape near-certain death to serve my clients...)

HomeBUYING Question


"Gary, do all homes have to be tented for termites before you buy them?"

***ANSWER:
No. It depends on a few things:

1. What does your contract say?
There’s no law that says a home must be free and clear of termites when it’s sold. Most people buying a home expect it to be and put that in the contract. But if you don’t put it in, it won’t happen.

2. Does the home actually have termites?
Many homes (I guess over 50%) have no termites.

3. What kind of termites?
“Drywood” termites, the kind that fly in swarms, are usually killed by tenting. But “subterranean” termites, that mainly live in the ground and in “mud tubes”, are killed by injecting poison in the ground.

4. Where are the termites?
If you have drywood termites in isolated, accessible areas, often a less expensive “local treatment” can be done instead of tenting.

5. What about alternative methods?
There are other legitimate options to kill drywood termites when a local treatment isn’t sufficient. The ones I’m familiar with are freezing, microwaving, and (believe it or not) electrocution.
 


HomeSELLING Question


"I'd like to sell my Clairemont condo and buy a little house in P.B. An agent said I could do a tax-deferred exchange and buy another home without paying any taxes. Is that correct?"

***ANSWER:
A little knowledge can be dangerous.

The agent was trying to help, but applied rules for investment property ("tax-deferred exchange") to your principal residence. That doesn't work and will get you audited.

Fortunately, I’ve got some good news…

If you’ve owned and lived in your home for at least 2 of the past 5 years, you can exclude up to $250,000 of your gain ($500,000 for couples).

And you there are exceptions to the 2-year rule. If you've had a major change in your job, health, finances, or family size, situation, or responsibilities, you may be eligible to sell before the 2 years and still defer much or all of your gain.

I've studied the IRS code, so feel free to call me to discuss your situation and I'll give you my opinion. BUT I'm not a tax expert, so you should definitely also talk with your tax professional.


Investing or Financing Question


"Hi Gary, If someone’s household income was around 85K and they wanted to buy a house valued at 570K but only need a loan for $410K, are there lenders who would touch this and bring in a house payment for $1,925 or less?

***ANSWER:
For a 30-year fixed loan at 6.5% rate, they’d be looking at $2,580/mo., NOT including taxes ($540/mo.) and insurance ($60/mo?).

To get a $1,925/month payment, NOT including taxes and insurance, they’d have to get a very low start-rate adjustable “negative amortization” (meaning the loan balance would go UP) that would soon adjust to more than the $2,149, and increase further later.

These loans are fine for many people who will definitely get a large raise or increase in income in the next year or two.

But if they won’t be getting that, they should not buy the house.
