True Story: Which Way Did Ego?
There are some agents out there who really fancy themselves. Several years ago,
one fellow actually used to send 8x10 glossy photos of himself to prospective
clients (no word on how many clients that lost him). My office manager tells me
of one who used to anonymously send himself flowers (“Gee, I’ve got a secret
admirer!”). And another agent took “In God We Trust” and inserted his name
instead. Give me a break!

Cities -- RUDEST Drivers
Connecticut auto club AutoVantage rated 25 major U.S. cities, from rudest to
most courteous drivers. For the 2nd straight year, Miami drivers had the worst
road rage. Portland, Oregon, drivers were least likely to tailgate, and St.
Louis motorists were least likely to swear at other drivers.

HomeBUYING Question
"My wife and I have been looking
for a home since December. And we’re getting frustrated. Every home we see is
too small, in poor condition, or priced too high for our budget. Can you give us
some advice?"
***ANSWER:
Sounds like you're stuck in a holding pattern and need to make some changes.
Assuming your agent is sharp and working hard for you (if not, get a new agent),
you need to either loosen up what you're looking for or increase your price
range. Please only increase your price range only if you can afford to.
Loosening up what you're looking for may mean buying:
- a townhome or condo instead of a house
- fewer bedrooms or baths, or a smaller home. If you buy a house, you can add on
later.
- a home without some feature, i.e. family room, garage, or yard
- a home that needs some work, be it “cosmetic” or more than that
- in a different part of town
Ways to increase your price may include:
- a different type of loan, such as fixed for 5 years instead of 30 years
- paying points to "buy down" your interest rate for a lower payment (in this
market, the seller may be willing to pay them)
- help from a relative
- getting extra funds by tapping into other assets, such as a 401K
Fortunately, there are so many homes for sale now and many excellent values.

HomeSELLING Question
"Hi Gary, I've got another
question if you have the time. Do you think a lot of buyer's agents start their
client's search by commission? Like would they limit their search to say 3% and
up and as a result they might never see my condo (which is offering 2.5%) in
their search? If so, would increasing the commission to 4% grab a lot more
attention do you think than dropping the price 10k (currently 275-295k)? Thanks.
***ANSWER:
Very few agents use the real estate fee as an actual search criterion. BUT, once
they do their search, some agents will indeed look at the % offered. And, a home
with a high fee will get more showings than one with a low fee.
My guess is that the additional $4,300 commission (from 2.5% to 4%) will be more
effective than a $4,300 price reduction, but not the $10,000 reduction you
mention.
Here’s my suggestion, assuming your condo is priced close to market value:
If it doesn’t already look like a model home, since you’re willing to “invest”
$10,000 in selling it, I’d suggest you:
1. do the fee increase AND
2. make some inexpensive cosmetics (clean, paint, landscaping, etc.) AND
3. pay a professional homestager $500 to $5,000 to stage your condo and make it
look like a model
By the way, if your condo is not priced close to market value, none of what
we’re talking about will sell it. So be sure it’s priced right!
Investing or Financing Question
"We’re going to
lose our home to foreclosure. We owe too much to sell and the bank denied our
short sale. I lost my job and my wife isn’t able to work, so we can’t make the
payment and definitely are going to lose our home. I hate the feeling of not
knowing what’s going to happen to me and my family. Can you tell me what to
expect?"
***ANSWER:
I’m very sorry to hear about your situation. Let me give you a preview of what
you can expect:
--Notice of Default--
Foreclosure officially begins when your bank files a “Notice of Default”, which
is public record.
--Minimum Three Month Waiting Period--
Once that Notice is filed, you’ll become very popular with letters, phone calls,
and maybe even personal visits from:
1. Your lender…asking you for payments and perhaps proposing ways to keep you in
the home. Based on what you said, they probably won’t work.
2. Investors…trying to steal your home.
3. Agents…trying to sell your home.
4. Lenders…trying to loan you money (if you have equity) and also possibly
trying to steal your home.
5. Attorneys…trying to get you to declare bankruptcy (which may or may not be
beneficial to you, but probably not based on what you told me).
…Some agents, lenders, and attorneys may legitimately be trying to help you AND
make a buck in the process. Many will just be trying to take advantage of you.
--Notice of Sale--
A minimum of three months after the Notice of Default is filed, the bank will
file a Notice of Sale.
--Minimum 21-Day Waiting Period--
More calls, letters, visits.
--Foreclosure Sale—
Your home will be sold at a foreclosure auction, aka “trustee sale”. Since you
said your payoff (loan balance + arrearages + fees + penalties) exceeds your
home’s value, no investor will buy it at the auction, so your home will go back
to the bank.
--Move Out--
Your bank will hire a real estate agent to see if you’re still in the home. If
so, the agent will offer you a little “relocation assistance” money. If you
don’t agree to move, you’ll be evicted and forcibly removed by the sheriff.
--Ramifications--
1. You will almost certainly owe nothing to the bank (verify with your attorney)
2. The amount the bank loses (aka “cancelled debt”) may be designated as taxable
income by the IRS, so you may get a 1099 and have taxes due.
3. The foreclosure will show on your credit for seven years, making obtaining
credit more difficult and expensive.
