Whoever Said “They’re Not Building Any More Land”?
Have you heard about the off-the-charts hotels, developments, and even islands being built in and off the coast of Dubai, United Arab Emirates? There’s the $1,600 to $4,100/night, 7-star Burj Al Arab Hotel (Wikipedia link). And check out the amazing “The Palm Islands” (YouTube, Wikipedia links) and “The World” (YouTube, Wikipedia links) developments. They’re mind-boggling.

True Story: Hope He’s Not Reading This!
For years, I taught a Learning Annex class called “How to Buy Duplexes, Triplexes, & Fourplexes as a Home or Investment” at the Red Lion Hanalei in Mission Valley. One night, I began class by telling students that some of what they’d learn also applied to buying a house or condo. Suddenly, a black-haired man with dark, crazed eyes shouted, “I don’t want to hear nothing about houses or condos! All I want to hear about is 2-4 units!!” I assured the man the information applied to 2-4 units. He grew even more agitated and yelled again, “I don’t want to hear nothing about houses or condos! 2-4 units only!!” This scene repeated a third time. He was so out of control that other students told him to calm down. I suggested he leave and have his tuition refunded. He’d have none of it and snarled his demands again. Unnerved, for the next hour I gave my worst class ever, all the while avoiding eye contact with his side of the room. Fortunately the lunatic left at the break…

HomeBUYING Question


"My husband and I went to view a home which we found on our own. We contacted the listing agent directly and he had an agent from his office meet us at the property. We were prepared to make an offer on the home when the agent who showed us the property got "weird". Given that the agency did not find us, we asked for a "gift" of the closing costs. The agent who showed us the house said that "they would try to work with us" but couldn't guarantee closing costs b/c the house is a short sale and sometimes the lender reduces closing costs. I understand that lender's aren't in the business of giving homes away (as you indicated in a previous newsletter, shorts sales tend to sell for market value). However, my research indicates that lenders do pay commissions. After all, a realtor isn't in the business of working for free either? It's a business transaction, all parties (seller's and buyer's agents) expect to be paid. The agent who showed us the home proceeded to get rude and stated that ethically if there was a commission to be had from us buying the home, she was entitled to it b/c she showed us the home. Is this true? She is not our agent. Aren't we merely "prospects"? Isn't she acting as the seller's representative b/c the seller's agent couldn't show the house himself? Don't they, the agency they work work, have a fiduciary duty to show the home for their client? Would we be justified contacting the CA Association of Realtors and/or California Dept of Real Estate regarding this matter? It seems that the agent who showed us the house is being unethical. She's blocking a potential sale b/c she is more concerned about her commission. Please advise."

***ANSWER:
Your question comes up occasionally. And you’re not going to like my answer, but I’m sure you want the truth.

There are 3 reasons you are not entitled to any of the real estate fee:

1. The real estate fee is agreed upon in a contract between the seller and the agent. Since you are not a party to that agreement, you simply don’t have the right to receive any of the money or insist that the commission be decreased. As attorneys say, you have no “standing”.

2. You say you found the house on your own. But you found it on your own due to the agent’s advertising. It’s analogous to seeing an ad for a car, walking onto a lot, having the salesperson show you the car, then telling the sales manager you found the car on your own so you expect a discount and the salesperson should not be paid. Try that and see what happens.

3. If you don’t have an agent, someone has to do the work during the escrow that your agent would have done. Such as: answering your questions, arranging and attending inspections, dealing with contracts and other documents, checking on your lender, keeping you informed, advising you*, watching out for your interests*, etc., etc., etc (*if they represent you). Be it the agent who showed you the home or the seller’s agent, someone’s got to do it and be paid for their work. You could argue that they didn’t do as much work because they didn’t originally tell you about the home. But agents aren’t paid for telling you about homes (if they were, I’d be retired by now). They’re paid for the end result of a closed escrow. Usually that entails a whole lot of work, occasionally only a moderate amount.

Bottom line:

I understand your feelings, but you’re not entitled to any part of the real estate fee. And you’d be so much better off having a good agent representing you and watching out for your interests.

BTW…whatever the circumstances, the agent was out of line to be read to you. That’s just not professional.


HomeSELLING Question


"I'm going to sell my home and I got price opinions from 2 agents, at 525K and 650K. The first guy had info on comps [comparable home sales] supporting his price. The other agent said she was confident she could get me in the $600's, but didn't show me any comps. I don't know who to believe. I know how important asking the right price is and I don't want to make a mistake. What do you suggest?"

***ANSWER:
First, some likely explanations for what's going on:

1. One of the agents doesn't know what they're doing. All too common. ...OR...

2. The 1st agent may be trying to price your home for a quick sale. ...OR...

3. (Most likely) The 2nd agent is trying to appeal to greed with an unrealistic price to trick you into hiring her. Then she'll push you to cut your price later. I've seen this happen hundreds of times over my career. This unethical ploy is so common it has 2 names: "highballing" or "buying a listing". Be careful!

So what should you do?

Get a 3rd opinion from a reputable agent. Tell him you're NOT selecting the agent based on price, but rather on skill. Have him explain how he arrived at his number & show you the comps. Read them, ask questions, then drive by a few & compare them to yours. Be objective so you can arrive at a fairly accurate figure.

Investing or Financing Question


"Hi Gary. My brother and I saw an ad and invested $2,000 in a real estate video/cd program on how to buy houses and condos under market. Are you familiar with [deleted] and his program? We’ve been working at it but haven’t been able to buy anything yet. Any help or tips you can give us would be appreciated.”

***ANSWER:
First tip: substitute the word “blew” for “invested”.

Most alleged real estate "gurus" like him have ended up bankrupt, in foreclosure, or prison. What your guy and most of these charlatans espouse involve fraud, deception, and cheating good people out of their money and security.

These snake oil salesmen also neglect to tell you that following their program is more than a full-time job, as it involves chasing properties, hounding people, and writing scores of offers just to get one accepted...if you're lucky.

My advice: find a sucker to buy your tapes on eBay.
