$225,000?
Manhattan Realtor Tom Postilio has a waiting list of people for one of five
$225,000 newly added parking spaces at 246 West 17th Street, a 34-unit condo
development to be completed January 2008. (225K is more than May’s median U.S.
home price of $223,700!)
New York limits new residential buildings in most of Manhattan to one space per
five units. That’s caused some condo buyers to pay as much per square foot for
their car's home as for their own. Some people buy spots as investments if they
don't own cars, renting them out to cover their costs.

(Follow-up to last weeks’
question & answer)
"We understand your response. However, knowing this woman has not been entirely
honest with us, could we use an agent that we felt more comfortable with and who
would "actually represent us" to submit an offer on our behalf? She claims that
she is "our agent" b/c she showed us the home. She said that is how it
"ethically" works. We have not signed a "buyer's agreement" with her. When I
looked up the code of ethics, it appears that we are "prospects" and she is
showing the house to represent the "seller". She arrived in lieu of the listing
agent. It seems like they are trying to pull some kind of bait and switch. It
makes us very uncomfortable. We'd feel better seeking our own buyer's agent,
provided we are entitled (which it seems that we are), who could inform us of
fair value, advise us of a reasonable offer, etc. It also seems that her over
concern with getting commission is potentially impeding the sale of the home. Is
that ethical and fair to the clients' that her agency represents?"
***ANSWER:
You are definitely entitled to use any agent you wish. And you certainly should
not feel obligated to use one who is rude to you or that you don’t trust.
There is an issue that won’t affect you, but could affect the agent you choose
to work with:
The agent who showed you the home may claim she was what is called the
“procuring cause” and is entitled to the buyer-agent commission instead of the
agent you choose. But from what you told me, she’d have little chance of
success. This does not affect you and should NOT be a factor in deciding how you
proceed. I just wanted you to know about it.
You also asked if her concern with getting the commission was ethical and fair
to her client.
Again, because the real estate fee is set in the contract with the seller, that
agent is not impeding the sale by preventing part of the fee from becoming the
“closing costs gift” you spoke of. But it sounds like she IS impeding the sale
by being rude and unprofessional. That would more fall under the category of
“poor service”.
Last comment:
We are currently advising our clients to avoid most short sales. They have a low
success rate, take weeks or months for an answer, and the banks usually insist
on a higher price or will not approve the sale.

"Re: how to fire a realtor. Went
online & got some vague answers. Wish to cancel my listing, based on realtor’s
breach of contract, regarding lack of communications. Any suggestions as to back
up info I might need???”
***ANSWER:
Good luck.
Listing contracts make it virtually impossible to fire an agent who isn’t
performing.
That’s why you don’t want to just use an agent that…
- you happen to know
- suggested the highest price
- had the lowest fee
- happens to work in the area
- happens to work for a known firm
- was in the right place at the right time
You need to choose a professional agent who is experienced and has a track
record of success. They or their team should be selling at least 25-50 homes per
year (we sell 150 on avg.).
Now that I’ve lectured you (for your own good!), here’s what I’d suggest:
1. Tell the agent why you’re not happy and give him 2 weeks to improve,
otherwise you’d like to cancel the listing.
2. If he doesn’t improve, ask to cancel the listing. If needed, tell him that
he’s better off as that no one wants an unhappy client and that unhappy clients
tell a lot of people that they’re unhappy.
3. If that doesn’t work, say the same thing to his broker.
4. If that doesn’t work, you’re probably stuck…

time I got a loan, I didn’t read the papers because there was just too much to
read. Are there certain documents in the big stack of papers you recommend I be
sure to read?"
***ANSWER:
You should read every single loan document you sign. But to be honest, I don't.
If you were to only read one document, read the "note" or "trust deed note".
(Just to confuse you, there’s another document called the "trust deed", but
that’s not the one I’m talking about.)
This important form is the actual "IOU" and details the main terms of your loan.
