HomeBUYING Question


"I tried to buy a condo about a week ago, but it fell out of escrow because my mortgage broker couldn't find a loan for me when my credit score fell mysteriously. My realtor's broker has informed me that the seller is entitled to my $3000 good faith deposit. My realtor never informed me of this possibility. Have you found this to be standard practice in your experience? I was just wondering if I should accept my losses or perhaps get legal help? Any suggestions you can offer would be greatly appreciated. By the way, thanks for all the useful info in your newsletter.

***ANSWER:
Don’t stand for that!

I’d be shocked if your loan and other contingencies were released after just one week. That’s WAY faster than normal. A loan contingency is usually released either 17 days after acceptance or when the loan is funded.

If your loan contingency was released in a week, you’d know about it, assuming your Realtor explained it to you…and assuming you were paying attention!

But all is not necessarily lost as you may have other contingencies (inspection, approval of disclosures, approval of title report, etc.) that you can use to exit the contract and receive your deposit back.

Bring these points up to your agent. Assuming he or she is looking out for you and is competent (not always the case!), they should be able to find an out for you to get your deposit back.

If not, then you may want to seek legal counsel.

HomeSELLING Question


"We’re planning to sell our home. Truth be told, our home is far from perfect. The kitchen is old, the inside needs a new coat of paint, the yard’s a mess, to name a few. Do you think we I fix up my home first or just sell it?”

***ANSWER:
Great question—another one that I hear all the time. And, like many questions, it’s not just a yes/no answer.

There are a few factors involved:

1. How profitable?
If the work is such that you can spend $1,000 and make $5,000, that’s sure an argument for it. If your $1,000 will return you $1,200, forget it.

2. Got money?
If your home could use $10,000 in fix-ups, but your bank balance reads closer to $10, maybe fixing isn’t for you. Or perhaps you can borrow the funds on a credit line or from family.

3. Got time?
This is a 2-parter: 1) Do you have the time to arrange for bids and repairs or make the repairs yourself? &/or 2) Can you wait to put your home on the market as repairs are bid and done, or are you in a rush to close? (Remember: repairs ALWAYS take longer than you think!)

4. Got skill? (optional)
Do you have the skill to do the work yourself?

5. Got desire and energy?
If #1-4 are no problem, but you’d rather avoid the hassle of it all, then perhaps you should do the minimum (cleaning, etc.) and get your place on the market.


Investing or Financing Question


"What’s causing all the foreclosures in San Diego?"

***ANSWER:
Last week I answered this question, attributing them to:

1. Subprime Loans
2. “Pay Option” ARMs
3. No-documentation loans
4. Zero-down
5. Mortgage Fraud
6. Increased Interest Rates
7. Lower Values
8. Difficult Short Sales
9. Tightened-up Financing

Upon reflection I left off at least four additional causes that dovetail with the first nine:

10. Negative Amortization Loans-
In exchange for lower payments up front, many people got loans with balances that went up, not down. They banked on continued crazy appreciation to bail them out, but things didn’t exactly work out that way. Instead, they’re upside down, unable to sell, and often unable or unmotivated to make their payments.

11. Predatory Lending-
True story: What happens when a loan broker makes a loan to an 87-year-old widow with payments greater than her entire (social security) income? She loses her home. Predatory lending is loaning with the knowledge the borrower won’t be able to make the payments.

12. Fear, Greed, Panic, & The Pursuit Of The American Dream-
It’s not true that “what goes up, most come down”. But it IS true that what goes up TOO FAR must come down. And that’s what happened here. Everyone wanted to make a buck, save a buck, &/or get that home…before someone else did. So values got out of whack and had to correct.

13. Negative Media Coverage (right or wrong)-
When the paper, TV, and web are saying the sky is falling, less people buy homes. And when less people buy homes, less people can sell, and more people lose their homes to foreclosure.

I could probably think of a 14th cause, but perhaps it’s appropriate to stop at #13.
