True Story: Was Their Accountant Arthur Anderson?
In the early 90’s, I sold foreclosures for a major lender you’ve heard of. I kept bringing terrific offers, almost full price, and they kept turning them down flat. Frustrated, I asked my bank contact what was up. She hesitated, but came clean “off the record”. By refusing the offers, the bank could put off showing the losses on their books until the next quarter, keeping their shareholders happy and stock price up. Temporarily that is.

"Is it legal for an agent to represent both a buyer and seller?"

***ANSWER:
Great question. It’s 100% legal in California. (Real estate laws vary by state.)

Is it a good idea?

If the agent is like most and has integrity, it’s perfectly fine. He or she will not favor either buyer and will keep all confidential information confidential.

If the agent lacks integrity, WATCH OUT. Anything you say can and will be used against you.

But why would you work with an agent who lacked integrity? I know, it’s hard to judge the honesty of people you don’t know.

….So isn’t that just one more reason to work with a reputable agent?


HomeSELLING Question


"I listed my home with an agent and it sold in three days. I asked her to take a lower commission because she didn’t have to work very hard. I know you’re an agent, but don’t you think that’s a little greedy?”

***ANSWER:
I’ll answer your question with a few questions of my own:

1. Since you want to pay her less because it sold quickly, would you have paid her a bonus if it took longer to sell?

2. Does it make sense to try to penalize her for doing a great job?

3. If I’d sell you the winning lotto numbers for next week’s $1,000,000 lotto for a $10,000, would you refuse because I didn’t have to work that hard to give you the numbers?

Ultimately, the true question is: are you paying by the hour or by the result?

You’re paying for the result. So stop complaining and pay the lady for her good work.


Investing or Financing Question


"Do you recommend using a mortgage broker or a bank to get a loan?"

***ANSWER:
Be extra careful if you use a mortgage broker.

There are some wonderful mortgage brokers out there and I've used a great one as my primary or #1 back-up lender for 23 years.

The problem is mortgage brokers have a tough job: they must keep track of the rules and policies and workload and rates and fees of hundreds of lenders to find you the best loan.

Another problem is all the untrained, unskilled ones out there that cause me excessive heartburn. I have problems in over half of my sales when the buyer uses a mortgage broker I don’t know.

So I prefer using a “direct lender”, where you're dealing with the source and not a middle man who has no control and can miss things.
