True Story: If You Don’t Sue, I’m Going To Sue
In California, residential real estate developers and condo-converters are liable for certain defects for 10 years. In the 80s, this led to incredible stories of alleged abuse and legal extortion. Back then, I heard of attorneys actually buying condos and tearing them apart looking for any defect they could have the Condo Association sue the developer for. …Attorneys went to HOAs and told them to sue. If they didn’t, they threatened to sue the HOA board members.

"Hi Gary. Thanks for your newsletter, we read it every week. My wife and I have never bought a home before, so there's a lot we don't know. For example, I'm sure we need title insurance, but it costs a lot of money so I'd like to know why we need it. Can you tell me?"

***ANSWER:
I'd be happy to...

Title insurance insures you in case something is found after you own the property that affects your title. These things could have happened MANY years ago and not be found until days or even years after you buy the home.

Common risks include:

- Forged deeds or mortgages
- Deed by person who is mentally incompetent
- Deed by a minor
- Deed from a corporation, unauthorized under corporate bylaws
- Deed by partnership, unauthorized under partnership agreement
- Deed given under fraud or duress
- Deed executed under falsified power of attorney

Some good news: The seller pays for the "Owner's Policy", which is the costlier policy. You as the buyer pay for the cheaper "Lender's Policy", for your lender.
 


HomeSELLING Question


"I’m going to sell my home in Pacific Beach and I've read several times that I should have 3 agents see my home for price evaluations. Is that what you recommend?"

***ANSWER:
Good idea, but be careful. Consider this...

In 1997, a doctor in Pacific Beach was moving to the Bay Area and called me to price his home. I evaluated it and told him $325,000 and to ask $335,000.

But as often happens, another agent tried to dupe the owner into hiring her by promising she could get $345,000. Fortunately, the owner trusted me and hired me and we asked $335,000.

Two days later, that very same agent brought us an offer for… $308,000. And actually tried to convince us THAT was the value, just days after telling the seller it was so much higher! I guess prices had dropped $37,000 in the past week.

We rejected the offer and a week later I sold the home for... $325,000--the exact figure I'd told my client.

My point?

Because she was competing for the seller's business, she misled him and inflated her estimate just to get the seller to list his home with her. And this happens a lot.

In fact, some time back, Consumer Reports wrote:

"Be wary of devious agents who estimate a very high sales price. This is called ‘high-balling’ to get the listing."

Agents obviously know everyone wants the highest price, so many seemingly nice, honest agents inflate their estimate to win business. What's worse is that often when an agent gives an honest estimate, many homeowners question that agent’s motives, thinking he or she is under-pricing for a quick sale.

Just be sure you keep choices of agent and price separate. Hire the agent with the best track record, then determine your price. Don’t fall victim to agents who mislead and tempt you with prices they know you won’t get.

Investing or Financing Question


"I'm a beginning real estate investor and want to get into rental property. I'm a little concerned because I think I might be too 'nice' and won't know how to deal with problem tenants. I think I read in your newsletter that you have rental property. Do you have problems with your rentals?"

***ANSWER:
Problems do happen, for example...

Several years ago, one of the tenants in my duplex was late with his rent. I gave him a little time, but he still didn't pay so I filed for eviction. He finally came up with the back rent and asked if he could stay. I agreed.

Two months later, the same thing happened: He didn't pay...I filed for eviction...he finally called saying he had the money. Except this time I didn't let him stay.

His response?

He tried to burn the apartment down! And with an innocent neighbor right next door! Fortunately, his arson skills were lacking and he did minimal damage.

My point?

Owning a few rentals in a decent area is usually not that difficult, but it does have moments. And while you should be nice and human and understanding with your tenants, ultimately you need to be a business person.

So if you're a pushover, I'd advise you to hire a property manager or choose something else to invest in.
