Real Estate’s Dirty Little Secret - #2
Most loan pre-qualifications and pre-approvals aren’t worth the paper they’re
written on. Too many unqualified “loan reps” crank them out without doing
anything resembling the homework they should. Basically, pre-qualifications and
most pre-approvals mean you’ll get a loan if…
- Everything you said it true
- You didn’t forget anything important
- It all checks out
- Nothing pops up unexpectedly on your credit
- Your loan program doesn’t change or disappear
- Interest rates doesn’t go up much
- The house appraises
AND
- Your lender really knows his/her stuff (most important)
You should only trust a “real” pre-approval, one where your credit, income, and
funds have all been verified and the loan package has been approved by an
underwriter.

True Story: Does Your Doggie Bite?
For 18 years, I knocked on doors. I got to know people who with time had me help
them buy and sell homes. Scores are still long-time clients and friends. I
chatted dozens of times with an elderly gentleman and his tired, old dog. On
perhaps my 30th visit, I happened to ask if his dog bit. The old fellow chuckled
at the thought and said never. Of course, at that exact moment, the old dog
decided it was his day to finally bite someone and chomped my backside, tearing
my pants but causing no injury. …BTW, this story reminds me a
scene from an old Pink Panther
movie.

HomeBUYING Question
"I’m buying a home and had 17
days from acceptance to remove my contingencies, which is today. The seller’s
agent just faxed over another disclosure paper, but insists I remove all my
contingencies today because this new disclosure isn’t on a legally-required
form. Do I still have 5 days from receipt to approve this disclosure or cancel
my purchase?"
***ANSWER:
Tell the agent to cool his jets and go back to real estate school.
It doesn’t matter whether it's written on a legally-required form or a cocktail
napkin. You have 5 days from receipt of any seller disclosure to approve the
disclosure or cancel the contract.
HomeSELLING Question
"My wife and I need to sell our
condo, but we owe $519,000 and it’s only worth about $495,000. An agent we know
told us we could do something called a short sale where the bank agrees to
accept the proceeds from the sale even though it’s less than the $520,000? The
agent made it sound so easy, which of course made me concerned. Is there any
downside?”
***ANSWER:
Not everyone qualifies for a short sale. If you do qualify, there are some very
real downsides you should know:
1. Credit-
Short sales usually cause major credit damage. Most mortgage lenders tell me
it’s as bad as a foreclosure. Others tell me it’s not quite as bad.
2. Tax-
You’ll probably actually owe income tax on the amount of “debt forgiveness”,
i.e. the amount your lender agrees to lose on the sale. There are exceptions.
3. Hassle-
Short sales are NOT easy. They require as much paperwork as getting a
“full-documentation” mortgage: tax returns, pay stubs, bank statements,
appraisal, etc. And then it takes weeks or even MONTHS for the bank to give you
a Yes or No. Most smart buyers and their agents avoid short sales for exactly
this reason as well as because of #4 below. And this causes them to take much
longer to sell.
4. Low probability of success-
You can go through all that hassle and be denied. I have no official stats, but
I’m guessing that at most 1/3 of short sales actually sell and close. For agents
REALLY knowledgeable in short sales, it may be double that.

"Hi Gary. I got
laid off awhile back and got behind on my bills and hurt my credit. I’ve had a
good job for two years now and I’d like to finally buy a home, but my FICO score
isn’t that good. Is there any way I can buy a home?"
***ANSWER:
A couple of years ago, I would have told you it was not a problem. You could get
a “subprime” loan, which were plentiful and available to people with challenged
credit. But those days are gone and subprime loans are almost extinct.
So I’d suggest you work on improving your credit. Here's some info I saw awhile
back on www.MyFico.com on how to do that:
=== Payment History Tips ===
- Pay your bills on time. Delinquent payments and collections have a major
negative impact on your score.
- If you miss payments, get and stay current. The longer you pay your bills on
time, the better your score.
- Paying off a collection account won't remove it from your credit report. It
stays on for seven years.
- If you have trouble paying bills, contact your creditors or see a legitimate
credit counselor. This won't improve your score immediately, but if you manage
your credit and pay on time, your score will get better over time.
=== Amounts Owed Tips ===
- Keep balances low on credit cards and other "revolving credit". High
outstanding debt can affect a score.
- Pay off debt rather than moving it around. The best way to improve your score
in this area is by paying down your revolving credit. In fact, owing the same
amount but having fewer open accounts may lower your score.
- Don't close unused credit cards as a short-term strategy to raise your score.
- Don't open a number of new credit cards you don't need, just to increase your
available credit. This approach could backfire and lower your score.
=== Length of Credit History Tips ===
- If you've had credit a short time, don't open a lot of new accounts too
rapidly. They lower your average account age, which has a larger effect on your
score if you don't have much other credit. And rapid account buildup looks risky
if you're a new credit user.
=== New Credit Tips ===
- Do rate shopping for a given loan within a focused time period. FICO scores
distinguish between a search for a single loan and a search for many new credit
lines, in part by the length of time over which inquiries occur.
- Re-establish your credit history if you've had problems. Opening new accounts
responsibly and paying them on time raises your score in the long term.
- It's OK to check your own credit report. It won't affect your score, as long
as you order your credit report directly from the credit reporting agency or
through an organization authorized to provide credit reports to consumers.
=== Types of Credit Use Tips ===
- Apply for and open new credit accounts only as needed. Don't open accounts
just to have a better credit mix - it probably won't raise your score.
- Have credit cards - but manage them responsibly. In general, having credit
cards and installment loans (and paying timely payments) will raise your score.
Someone with no credit cards, for example, tends to be higher risk than someone
who has managed credit cards responsibly.
- Closing an account doesn't make it go away. A closed account will still show
up on your credit report, and may be considered by the score.
