True Story: Did He Even Read It Before He Faxed It?
Years back, we had a sale fall through when the buyer (not our client) was fired the day before closing. Hoping for his deposit back, the buyer faxed us
his termination letter as proof that “it wasn’t his fault”. To our surprise, the letter listed specific, graphic quotes of what he said to female employees
that got him fired for sexual harassment (WAY too crude share with you). His efforts didn’t exactly win the seller’s sympathies…or his deposit back.

"I’m saving up money for a down payment, but I’d like to get into a house now since prices are so attractive and there are so many homes for sale to
choose from. What do you think of getting a home on a lease-option?"

***ANSWER:
There are some +’s and –‘s, that I’ll go over in a moment. But first, be aware that even with the subprime meltdown, you can still get a zero-down loan
up to $417,000 if you have good credit.

=== Upsides To Lease/Options: ===

1. Buy Now
You’re able to have the right to buy a home, even if you’re not able or willing to buy it right now.

2. Less At Risk
At the end of the lease/option term, if you decide you don’t want the home, you can walk away, losing only the “option money” and any excess rent
you paid.

=== Downsides To Lease/Options: ===

1. Hard To Find
Few sellers will sell under a lease/option

2. Complex
Lease options are complex. Do the contracts correctly now or go to court later.

3. Loss Of Option Money
If you don’t exercise your option, you lose your up-front “option money” and any extra rent you paid.

4. Lease/Options Are Erased If The Home Is Foreclosed!
One of our bank-clients just assigned us a foreclosure where the tenant had a lease/option. We had to break the news that his lease/option was kaput
and his option money gone. While I know of no protection against this, you should at least file a Request for Notice of Default and Request for Notice
of Delinquency so you know if the seller stopped paying his mortgage, letting you decide if you’ll stop paying your rent.


HomeSELLING Question


"My wife and I need to sell our condo, but we owe $519,000 and it’s only worth about $495,000. An agent we know told us we could do something
called a short sale where the bank agrees to accept the proceeds from the sale even though it’s less than the $520,000? The agent made it sound so
easy, which of course made me concerned. Is there any downside?”

***ANSWER:
Last week I went over the downsides: Credit damage, income taxes due, hassle, and low probability of success.

This week, we’ll go over the basics that banks look for in deciding if they’ll approve you for a short sale. It’s basically the opposite of getting approved
for a loan -- you must show that you can’t pay the mortgage.

You must prove to the bank that you have…

1. Hardship
You must have a hardship that is “not your fault” that happened to you since you got your mortgage. It’s must be something that would keep you from
paying your mortgage. Common hardships include death, divorce, illness, job loss, other loss of income, etc.

2. Inability to pay
You must prove to the bank that you can’t pay your mortgage. In other words, if you got a divorce, but both you and your soon-to-be-ex each easily
make enough to pay the mortgage and normal living expenses, it’s unlikely you’ll be approved.

3. Few assets
If you’ve got more than a few bucks in the bank, the bank will either ask you to pay some or all of the loss, or they’ll turn you down flat.

4. Appraisal
Your home must appraise near or below the price you’re selling it for. The bank won’t let you sell it too cheap…which is often what it takes to hook a
buyer given all the short sale delays and low probability of success.
 


Investing or Financing Question


"Have you heard about those loans with silent seconds where you pay no interest on a second loan?"

***ANSWER:
Yes. They can be very good programs if you fit the criteria and understand the downside.

Typical Criteria
1. Most programs are only in specific census tracts in specific areas, such as Escondido or El Cajon.
2. They’re usually only for first-time homebuyers (defined—oddly—as not having owned a home in the past 3 years)
3. They typically have income limits.

***Beware that most have a requirement that if you sell within a certain period of time and make a profit, the government entity that loaned the money
gets a share (half?) of the profits.
