Clarification…

Did ya catch me last week on Channel 10 commenting on the La Jolla landslide? My sound bite was out of context and sounded like I was saying La Jolla values would fall 30-40%. What I actually said was that’s the value the destroyed and damaged homes had lost.

True Story: Don’t Say It If You Don’t Mean It
In 1990, an older couple in Bay Park jokingly told me, “If you ever had a buyer for our home for $300,000, we’d sell…ha ha ha.” I called them the very next day with a young couple ready to pay them the $300,000. They were shocked, but followed through and sold their home to my clients.

HomeBUYING Question


"We want to cosign to help our 40-year-old daughter buy her first home, but with prices so high here in San Diego she can't afford the payment. Can you give us any advice?"

***ANSWER:
Consider a small duplex for her first home, like my wife and I did in the mid-1980's. The rent should more than offset the increased monthly payment due to the 2nd unit, thus effectively lowering her payment. Plus she's buying more real estate, which is a great long-term investment.

Be sure to keep a rainy day fund for when you have a vacancy.


HomeSELLING Question


"Dear Gary, I've been told that the San Diego Tax Assessor will allow a senior citizen to sell their existing house in another county (ie. Orange County), allow you to retain your existing property tax base, purchase a home in San Diego county and forward your original property tax base to the new home in San Diego county. This obviously "side-steps" the Tax Assessor from assigning the 1% of net value on the new purchase. Is this true? If so, what are the restrictions (ie. time restrictions, buyer age restrictions, "buy-down" restrictions)?"

***ANSWER:
If it sounds too good to be true...it still might be true! Yes, seniors CAN sell a home and keep your low property tax base.

Proposition 60 allows homesellers 55 or older a one-time opportunity to transfer their existing low property tax bill to their next home when they sell their home and buy another. Some key rules:

1. The replacement home must be bought or newly constructed within 2 years before or after of the sale of the original home.

2. Claims must be filed within 3 years of buying or building the replacement home.

3. The new home must cost 100% or less than the old home. Or you may go up 5% if you buy within 1 year after selling the old one, or 10% if between 1 and 2 years.

4. The replacement home must be in San Diego County or, per Prop 90, in any county that agrees to be a “reciprocating county”. Last I checked those were:
- Alameda
- Los Angeles
- Orange
- Santa Clara
- San Mateo
- Ventura

Investing or Financing Question


"I own rental property in Logan Heights and southeast San Diego in some pretty rough neighborhoods. I'm sick of all the bounced checks and related delays. I have a mortgage due every month whether they pay me or not. So I've decided to require cash-only for rent, but somebody told me that's not legal. That doesn't make any sense. Is that true?"

***ANSWER:
On January 1, 2005, it became illegal for owners and managers of apartments in San Diego to require cash payment for rent, with one exception:

If the tenant bounces or stops payment on a check, you may require cash, provided you give written notice the check bounced and state the time period the tenant must pay cash, to a maximum of 3 months.

Note that if your rental agreement doesn't give you this right, you must give the tenant a "Notice of change of Terms of Tenancy". There are additional rules that apply, so talk with your landlord-tenant attorney.
