True Story: Equally Unhappy
Years ago, a gentleman hired me to sell his home. A couple of weeks later, I produced a man who made a low offer on the home. As can happen in home negotiations, the buyer and seller became upset with each other over imagined offenses committed by the other: stubbornness, refusal to negotiate in good faith, etc. It was almost funny that they’d both created horrible and inaccurate images of the other. Funny except we’d reached loggerheads: $4,000 apart and neither would budge, despite long discussions over the phone. Then I got an idea: I told each (truthfully) that if they both moved $2,000, they’d be “equally unhappy” and move forward with the sale they wanted. To my surprise, they both agreed and we sold the home!

“Does pest control clearance cover just termites, or does it also cover rats and ants, etc.?"

***ANSWER:
The term “pest control clearance” is a misnomer, as it implies all kinds of bugs, rodents, and other pests will be eradicated.

In reality, a pest control clearance covers “wood-destroying pests and organisms”, which are mainly termites, dryrot, and fungus.
 


HomeSELLING Question


(From last week) "We really want to sell our home, but we owe more than our home is worth. What options do we have?”

***ANSWER:
I’d mentioned last week that one option is to do a “Short Sale”. A short sale is when someone owes more than they’d net from a sale. They find a buyer and ask the existing lender to take less than what is owed in order to allow a sale.

While a short sale can be the best option for many people, there are several downsides that few agents mention:

1. Tax Impact
If you sell your primary residence, there’s a good chance you’ll owe income tax on the amount the lender forgives. Why in the world would that be? The IRS view is that if a bank forgives money you owe them, it’s like you made money. And unfortunately, you can’t offset this gain with the loss on your home, as loss on a principal residence is not deductible. There is a bill in congress that, if passed, will provide relief from this very unfair tax. FYI: Because loss on an investment property is deductible, most people selling an investment property on a short sale end up with no tax. (Consult your tax professional.)

2. Credit Impact
Unless you get lucky, a short sale goes on your credit as a “settled account”, meaning settled for less than owed. For years, I’ve gotten conflicting views on the impact. This makes no sense, but many lenders tell me they view a short sale as though it’s a foreclosure. Others tell me it causes credit damage, but not as much as a foreclosure.

3. Difficulty
Short sales are a slow, difficult process often taking up to three months. Banks don’t like to do them and they don’t have their most motivated people handling them. They require extensive documentation, as much as applying for a loan! Due to the painfully slow time frame and #4 below, smart agents don’t like to sell them and informed buyers don’t like to try to buy them.

4. Denial
After months of waiting, many short sales are denied due to price, “hardship”, or other unexplained reasons. On price, banks aren’t in the business of giving money away, so they appraise the home and insist on a close-to-market (and often above-market) price. Too low and they deny the short sale. Regarding “hardship”, banks only do short sales if the seller/borrower has a sufficient hardship that meets their tough, occasionally unrealistic criteria. I estimate over 50% of short sales are denied.

5. Agent’s Lack of Skill/Experience
Short sales are complex, so few agents are experts at them. That means most are unnecessarily delayed and often denied. (I’ve personally done some 200 for clients, but I usually refer clients to other agents for the reasons stated above.)

In summary…

In spite of these downsides, short sales can still be the best option for some people. But they’re not easy, not fast, not without credit or tax downside, and not guaranteed.
 


Investing or Financing Question


"Not only do I not like paying mortgage insurance, it isn’t even tax deductible. Can you still get zero down loans without paying mortgage insurance?"

***ANSWER:
They’re hard to come by. But my lender has something unique they call “tax advantaged mortgage insurance” or TAMI for short.

Instead of charging you mortgage insurance, which is rarely tax deductible, they charge you a slightly higher rate. The interest is generally tax-deductible, while mortgage insurance isn’t.
