HomeBUYING Question


"I’ve just had an offer accepted on a home. If my inspector finds things like a leaky roof or the heater doesn’t work, does the seller have to fix the items?"

***ANSWER:
Nope.

The seller is only LEGALLY required to have:

1. Operative smoke detectors in the “sleeping areas”.
2. Earthquake straps on the water heater
3. Low flow toilets…unless you agree to change within 30 days of closing.

However, if you find defects that the seller will not fix or credit you $$ for, the standard contract gives you the right to cancel and receive your deposit back…provided you’ve objected within the time limits specified in the contract.

Footnote: “But what about termites!?”

A termite (aka “pest control”) clearance is not a LEGAL requirement. But most homebuyers ask for one in their offer and the seller agrees. Thus the seller would have to comply, as they would with any contract terms.
 


HomeSELLING Question


"It seems like the buyer has all the rights to get out of a contract. Can the seller back out if he gets a better offer or for some other reason?”

***ANSWER:
Here’s the idea:

The buyer is coming into many unknowns when buying a home, including:

- The physical condition of the home
- Whether a bank will loan them the money to buy the home
- Neighborhood issues (crime, noise, traffic, etc.)
- Etc.

So it makes sense for the buyer to have a reasonable contingency period to investigate these issues before being obligated to close the purchase.

On the other hand, the seller has few unknowns other than the buyer’s ability to qualify for a loan. So the contract gives the seller a contingency period for this.

(Warning: this clause is poorly and weakly written in the standard California contract. When representing a seller I rewrite the clause so the seller can be reasonably sure the buyer is qualified.)

Regarding specifically whether the seller can back out if he gets a better offer, the answer is no. The whole idea of a contract is to reach an agreement and bind the parties involved. If the seller could back out like that it would defeat the purpose.
 


Investing or Financing Question


"With all the changes in home loans, are there still good adjustable loans out there? I’ll probably need to go adjustable in order to qualify to buy a condo I’m looking at."

***ANSWER:
There have been many changes. And one has produced a very surprising result:

Until recently, you qualified at the temporary low “teaser” rate of an adjustable loan. But now it’s usually easier to qualify for a fixed rate loan.

Why?

The flood of foreclosures.

Many (most?) are due to what are called “adjustable resets”. When people qualified only for the low teaser rate have their payment jump – surprise! – they can’t afford the new higher payment.

Now lenders aren’t qualifying borrowers at those low teaser rates. They’re qualifying them at higher rates, sometimes the maximum rate the adjustable loan can go to.

So it’s usually easier to just qualify for a fixed rate that’s lower than the rates.
