Saturday’s seminar “How To Buy A Foreclosure In San Diego” was a resounding
success. Many of the apx 100 attendees said they learned a boatload of valuable,
useful info about buying a foreclosure. It was such a success, I’ll be doing the
seminar again on April 19th.
Why The Newly Raised Loan Limits
Won’t Work
“Conforming” home loans (up to 417K) have lower rates than “jumbo” loans
(417K+). The new stimulus bill Bush signed raises the San Diego limit to
$729,750 for confirming Fannie Mae and Freddie Mac loans, plus raises FHA loans
to an unknown amount. So you can now go get a lower rate on a loan between 417K
and 729K, right?
Unfortunately, that’s not the case, for 3 reasons:
1. James Lockhart, Director of OFHEO that regulates Fannie Mae & Freddie Mac,
says it will take 3-4 months to implement.
2. This new in-between category (called “jumbo light”) of loans 417K to 729K
will be packaged and sold to investors separately from conforming loans to 417K.
It’s anticipated until there’s a track record for them, investors will be
cautious and demand higher returns. That means higher rates.
3. Fannie and Freddie have budget limits of how much they can buy. The stimulus
bill did not raise those limits, meaning that they could hit a ceiling and not
be able to buy loans at some point.
True Story: Can’t You Go To Jail For That?
Remember last year when people protested at several banks that were foreclosing
on their homes? Here’s the behind the scenes story you may NOT have heard: I was
told a “consumer group” approached major lenders, threatening to protest
them…that is unless the banks gave them a financial contribution. The bank’s who
didn’t cave in were picketed. Isn’t that called extortion?
Website-of-the-Week: They’re Charging For This?
Did you read in the San Diego Union about a new company (www.youwalkaway.com)
that’s sprung up? They promise to “guide” homeowners through their
foreclosure…for a thousand bucks! My personal advice if approached by them: You
RUN away! Just my opinion…

HomeBUYING Question
"Hi Gary, I see there’s a
foreclosure in escrow near your listing on XXXX Drive. Theirs is listed at
$434,000. Yours is a little bigger and I’m wondering if the bank will sell it
for $440,000?"
***ANSWER:
One comp doesn’t make the market. They will not sell for $440,000.
Background and explanation:
The house this person speaks of is worth in the high $400’s based on recent
sales, even with market adjustments.
There is one slightly smaller property nearby in escrow listed at $434,000. A
little investigating showed that it was reduced from 498K to 434K and went into
escrow immediately. So it likely was under-priced.
Here’s my point…
Appraisers use three to four “sold comps” to determine value. I try to use five.
There’s a reason for this.
One isolated sale does not determine market value. There could be extenuating
circumstances.
So if you’re trying to determine the value of your home or a home you’re
interested in buying, look at 3-5 sold homes. Look at homes for sale too, as
they set a limit on value (“if no one will pay $X for that home, this home
probably isn’t worth $Y”). Remember to make adjustments for differences in the
homes and the market.
Don’t rely on just one home to tell you what another is worth.
HomeSELLING Question
"Do you do short sales?”
***ANSWER:
I’ve done about 175, but I’ve chosen to sit out the “fun” during this market
cycle.
Short sales are torture for homesellers, homebuyers, agents, and banks. That’s
probably why the good people at the banks who handle short sales can get so darn
cranky.
If you’re thinking of buying a short sale…
Don’t waste your time.
Odds are you’ll wait 6 weeks to either be denied or have the bank insist on a
higher price that what you thought you were paying.
If you’re thinking of selling and need to do a short sale…
You need an expert agent to tell you if you likely qualify, know what
documentation is needed, help you write your hardship letter, know each bank’s
policies, and push it through.
Beware of all the agents claiming to be “short sale experts”. Few are. There are
too many subtle but critical things that most agents don’t know about short
sales.
Since I’m not handling short sales, I refer people to a sharp, experienced agent
who used to be one of my biggest competitors on short sales in the 1990’s. He
actually IS a “short sale expert”.

Investing or Financing Question
"I’m interested in investing in foreclosures. If I used the credit line I have
on my house to pay cash, how much do you think could I get off the price of a
foreclosure?"
***ANSWER:
Before I answer that, let me warn you with some shocking news that may blindside
you:
There’s been some “freezing” going on here in San Diego…and I’m not talking
about our recent chilly weather.
Some banks have started “freezing” and/or decreasing home equity lines of
credit. I’m talking about EXISTING credit lines already taken out that you are
assuming will be there whenever you need the money.
Banks are doing this because with prices lower (great news, if you’re
investing!) they want to be sure they’re not loaning at or above the home’s
value. But instead of a sensible review of their credit lines, some are taking a
meat cleaver approach and just hacking credit lines.
One fine gentleman I know was remodeling his home, funding it from his credit
line. Halfway through the remodel, without warning his bank slashed his credit
line by 60%. That’s a teeny-weeny problem when your home is half done and you
owe your contractor a lot of money.
Or when you’re depending on your credit line for any other important reason.
NOW, I’ll answer your question. …And you may be disappointed.
Banks aren’t overly impressed with cash offers on their foreclosures. Sure, they
want a buyer with solid financing. And cash is pretty solid.
But just because you’re paying cash, they’re not going to drop an extra 20%...or
10%...or even 5%.
From my experience, you can expect a 1-3% discount for paying cash.
Sorry, I hope I didn’t burst you’re balloon, but that’s reality.
