True Story: Through The Eyes Of A Child
The house next door went up for sale when I was a kid. On several Sundays, I saw
a man sitting on the front porch, reading the newspaper. I never saw him do
anything else. So of course, I assumed an agent’s entire job consisted of
sitting and reading the paper!

I’m talking with a guy last week who lives in a condo in University City. When I
referred to his UC neighborhood, he “corrected” me saying, “No, I live in UTC”.
Just a reminder to anyone who cares: UTC is short for University Town Centre,
the mall. So if someone you know insists that they live in UTC, please inform

HomeBUYING Question
"We're going to look for a house
in Carmel Valley, probably Torrey Hills or the Highlands. The last time I
bought, I felt like I was guessing how much to offer. My agent was no help. Any
suggestions? Don't most people offer 3% below the asking price?"
***ANSWER:
Sorry, there's no set formula. What you should offer depends on 4 things:
1. VALUE-
The #1 factor in what to offer. Forget "always offer 5% below list price" or "if
you want it, offer full price." These focus on ASKING price--which has
ZIP/NADA/NOTHING to do with value! You need to know the home's value before
deciding what to offer. So educate yourself on values and work with a trusted
Realtor.
2. COMPETITION-
If you're the only bidder, you might offer under the value. If there are other
bidders, you may lose out by offering low and need to offer full value, or even
a little more. (Yes, even in this market many homes get multiple offers! About
1/3 of mine do.)
3. SELLER MOTIVATION-
If the seller is highly motivated (i.e. bought another home, has financial or
personal pressures, etc.), you may get a better price. If not, expect less
negotiating. Find out why the owner is selling. Be aware you don't always find
out the real reason.
4. YOUR MOTIVATION-
If you really want the home, don't mess around with low offers that could allow
other buyers to jump in and buy the home from under you. And low offers offend
sellers--I've had many seller-clients hold out for an even higher price or
refuse altogether to sell to someone who offended them with a low offer.
HomeSELLING Question
Question from my “How To Buy A
Foreclosure…” seminar:
"If your bank turns you down for a short sale, then forecloses on your house and
sells it for less than the price you could have gotten, can you sue them?”
***ANSWER:
As you know, in our society today people can and do sue for the most ridiculous
things.
So, yes, I guess you can sue them.
But unless you’ve got a silver-tongued devil for an attorney AND a clueless
jury, you’re going to lose…if a judge even lets it go that far.
The reason is simple: Your lender has no legal obligation whatsoever to agree to
a short sale.
Of course, you might be thinking, “OK, so lenders aren’t legally required to do
a short sale, but wouldn’t they rather do one than foreclose and lose even more
money?”
I’ll answer that first with what I heard at a recent dinner meeting with bankers
who handle short sales and foreclosures:
“The borrower agreed to pay the money back. So we’re not just going to do short
sales for everyone who asks.”
While I believe they feel that way, I think there’s a bigger picture reason why
banks turn down so many short sales:
If they made short sales too easy, the flood gates would open and hundreds of
thousands more people would do them instead of just hanging on and paying that
mortgage.
Just my opinion.
Investing or Financing Question
"My sister wants to buy a home
and she went to a bank and they ran her credit and told her she has some late
payments on her car. But she's never financed a car, so the credit report is
wrong. The people at the bank were nice but didn't really give her any advice.
What should she do to clear up this error?"
***ANSWER:
Your sister and anyone who has what they think is incorrect information on their
credit should contact the credit agency that developed the report. The Fair
Credit Reporting Act (FCRA) generally allows the agency up to 30 days to
investigate disputed items. Most make a special effort to quickly resolve
disputed information affecting a home loan decision.
