With the rise of the Canadian dollar (aka the “Loony”) relative to the dollar
and San Diego’s plentiful real estate bargains, I’ve seen a rush of Canadians
invading San Diego. They’re looking to buy homes, second homes, and investments.
I’d guess those factors must make San Diego prices half of what they were a few
years ago for our Canadian neighbors.

True Story: This One’s A Gem
Twenty years ago, a buyer’s agent personally presented his offer to the seller
and his agent. What wasn’t common was for the buyer to attend. But that’s what
happened on a pricey $300,000 (prices have changed!) home I had for sale. The
intense, peculiar 40-ish man with coke-bottle glasses presented his full-price
offer, to be paid in…gemstones! He said he welcomed the seller’s CPA to review
the offer. But if the CPA advised against it for tax reasons…he’d sue the CPA!
Likewise, the seller’s attorney could review the offer, but if he said it wasn’t
legal…he’d be sued! When the odd fellow finished, my client politely thanked him
and showed him out. I then called the agent, rejecting the offer and saying his
client was never to come back to the house.

"Hi Gary. You sure are the king
of foreclosures. My wife and I want to buy one, but need to sell our home first.
Will a bank take a contingent offer on a foreclosure?"
***ANSWER:
Absolutely no chance.
Even if your home is in escrow, no bank will accept the closing as a
contingency.
Sorry.
HomeSELLING Question
"Hey Gary. I'll be selling my
rental house and the place is a mess so I plan to evict the tenants and fix the
place up. Do you know any good contractors? Also, I heard there's some law that
you have to give the tenant 60-days notice to move out. Is that true?"
***ANSWER:
Yes, I do know good contractors that I recommend to my clients, so just call me
at (858)457-KENT and I'll give you their names. As to your second question about
tenant notice...
State law requires that a landlord with a month-to-month tenant generally must
give a 60-day notice to terminate tenancy if the tenant has lived there for one
year or more.
However, an owner selling a rental may give a 30-day notice if ALL the following
conditions are met:
1. Owner has signed a contract to sell the property "to a bona fide purchaser
for value";
2. The owner has established an escrow with a licensed escrow officer or real
estate broker;
3. The buyer is a "natural person(s)";
4. The buyer in good faith intends to live in the property for at least one year
after termination of the tenancy;
5. The termination notice is given within 120 days of opening escrow;
6. Notice has not previously been given to the tenant under this law; AND
7. The dwelling is alienable separate from the title to any other dwelling unit.
The normal 3-day notice to pay rent or quit, etc., has not changed. Please
verify all the above information with your legal counsel.
Investing or Financing Question
"Have you heard
about the government plans to bailout homeowners who are upside down or have
loans with increasing rates? I bought in 2005 and put 25% down and got a fixed
rate, paying a higher rate than those low teaser rates other people got. It’s
2008 and my loan equals my home value. So the feds want to use my and your tax
dollars to bail out people who put zero down or got an artificially low rate for
two years. I put 25% down with my hard-earned money and paid a higher fixed
rate. And the feds want to help THEM and not me. They shouldn’t help them or me!
We’re all grown ups and made our own decisions. Please put this in your
newsletter so people will call their congressman and tell them how unfair and
wasteful this is."
***ANSWER:
Request granted.
Other dumb ideas being pushed by local groups, the White House, Congress, and
people running for President:
- Local Groups –
Create a “land bank” where the city (if I recall correctly) would buy foreclosed
homes. We all know how much extra money the city has and how well they handle
their finances!
- White House -
Give people a $7,000 tax break if they buy a foreclosure. Imagine your home is
for sale, competing with a foreclosed home for sale next door. The government
wants to pay a buyer to buy that home instead of yours.
- Congress –
Senator Dick Durbin and others want to allow bankruptcy judges to decrease home
mortgage loan balances and interest rates of people in bankruptcy. A 5th-grader
would understand that would cause mortgage lenders to raise rates, require
bigger down payments, and become much stricter on who they’d loan to. But maybe
Congress isn’t smarter than a 5th-grader.
- Presidential Candidates -
Have the government buy thousands of loans or foreclosed homes and resell them.
And it “wouldn’t cost the government a dime”. This one is a real no-brainer, as
in you have to question if someone has a brain to say this wouldn’t cost
anything. We all know how efficient the government runs.
