Did you hear the Carlsbad couple lost their absurd lawsuit yesterday? They sued their agent because they said they overpaid for a home. They paid 1.2M, while two similar models sold for less. They didn’t mention theirs was vastly superior, and that one of the others required a whopping 2-year leaseback to the seller. Ya think that might decrease that home’s price just a little? Score one against greed and blaming everyone else for your actions! …Remember the La Jolla home I mentioned last week listed 300K under market? We sold it with TWENTY-THREE offers!

Report From The Foreclosure Conference I Attended
Just back from the largest banking industry foreclosure conference in the U.S. Acclaimed economist Richard Thornberg was the key speaker. He confirmed my comments last week: most government attempts being bandied about to lessen foreclosures would do more harm than good.

He’s against allowing bankruptcy judges to lower people’s mortgage balances and their interest rates, as well as the foolish “90-day foreclosure moratorium” proposed by certain presidential wannabes. Instead of helping, both would INCREASE foreclosures by pushing banks to further tighten lending standards and raise rates in response to less security for their mortgages. If we had 10% mortgage rates requiring 25% down and perfect credit, people wouldn’t buy homes and we’d see MORE foreclosures.

Thornberg said the best solution lies in preventing further foreclosures by protecting credit market liquidity, such as in the BearStearns sale. Complaints that it only bailed out Wall Street are pandering or naïve. It’s ridiculous to say the “little guy on main street” (you and me) isn’t helped by safeguarding against a credit market collapse and severe recession.

…Last time I checked, I liked the idea of a) being able to borrow money for a car or home, b) having a job, and c) my savings being safe from bank failures. How about you?

As you watch the news on the various bailout proposals, keep in mind that pesky old “law of unintended consequences”. Politicians are competing over who can spend more of our tax dollars to appear that they’re trying to help us…no matter how much it hurts everyone!

True Story: Could You Live In 200 Homes?
At the foreclosure conference I just attended, speaker and economist Richard Thornberg told of one individual investor who actually bought 200 homes in Las Vegas with “owner-occupied” zero-down subprime loans. With Vegas’s sour real estate market and 200 mortgages resetting to higher rates, no doubt he’s lost all 200 to foreclosure.

HomeBUYING Question


"A bank foreclosure just came up that we think is about 10% under-priced. My wife and I want to buy it to live in and would like to get a good deal. The main thing is to get the home, but of course we don’t want to overpay. Do you recommend we offer below, at, or above the list price?"

***ANSWER:
Great question.

Each bank has different policies for multiple offers, each bank representative has different approaches, and each situation has different dynamics. So there’s no sure answer, but I’ll give it my best shot…

If you feel it’s a hot property and will attract immediate offers, then offer at least full price or more, sometimes much more. (I just had one property sell for OVER 30% above list price.)

If it’s in an area with many foreclosures and/or an unattractive home, you might do best by offering full price or just slightly over.

What about offering below list price? Contrary to popular belief, well-priced homes commonly receive multiple offers quickly. So an offer below list price would be risky and unlikely to secure the property.


HomeSELLING Question


"Our family is growing and we're running out of space. We're expecting our third child and we're trying to decide if should stay and add-on or sell and move up. What advice can you give us?"

***ANSWER:
My best advice is to ask yourself these questions:

1. Do you love where you live? Does your current neighborhood still fit your needs for work, friends, schools, activities, etc.? Or would you prefer another area?

2. Would you be overbuilding for your area--something that could hurt you for later resale? Or would you be catching up with the neighborhood? Is the whole neighborhood improving, or would it be just you?

3. If you'd be adding "out", is there enough yard or would you have little yard left?

4. Would an add-on capture a view, which would be a "windfall" benefit (and increase in your home value.)

5. Are you prepared to live through months of construction or potentially move out and live elsewhere for awhile?

Investing or Financing Question


"Gary did you know property taxes for the 2008-2009 fiscal year are going to be 2% instead of 1%?"

***ANSWER:
(Not an investing or financing question, but I felt you’d find it informative.)

Taxes aren't going to be 2% of your property value.

Under Proposition 13, property taxes can only INCREASE 2% per year, after starting at approximately 1% of your property’s assessed value.

For example, if you buy a home for $90,000 (remember, this is an example!), your taxes will be about $1,000. Next year they will be $1020, followed by $1040.40 the next year, etc.

So, no worries, state law prevents politicians from hiking property taxes. Depending on your point of view, you may consider that a good thing considering the California budget situation. No doubt they’d be hiking property taxes if they could.
