San Diego City Attorney Mike Aguirre Sues To Make San Diego A “Foreclosure Sanctuary”
When Kevin from my office emailed me this story, I thought it was a practical joke. Realizing it was true, I was overcome with both shock and laughter. Indeed, our own beloved Mike Aguirre is or will be suing most major lenders to prevent them from foreclosing on homes in the city of San Diego. In his words, he wants to make San Diego a “foreclosure sanctuary”. I certainly support the goal of helping people keep their homes and decreasing blighted homes. And Aguirre says this suit is for leverage, but frankly, his approach is preposterous. When someone doesn’t pay their mortgage, the lender’s recourse is to foreclose. Take that away and NO lender will ever make a home loan in San Diego.

HomeBUYING Question


"Hi Gary, I don’t really want a condo. They’re not a good investment, with the homeowner fee and that they don’t go up in value. A house is a much better investment, don’t you think?"

***ANSWER:
I hear that all the time, and I couldn’t disagree more.

Of course, you have your personal preferences, and that may be a good reason to buy a house over a condo.

But in the long run, on average, in a given neighborhood all real estate appreciates at about the same rate.


HomeSELLING Question



"We have a rental house that we bought at the peak of the market. It’s got a $600 negative cashflow every month. We owe $525,000 and I’m guessing it would sell for about $475,000. We can barely afford to continue like this. What do you suggest?”

***ANSWER:
I’m sorry to hear about your situation. You’re definitely not alone, as millions of Americans face the same challenge with their homes or investment properties:

As I see it, here are your options, with my comments:

--- 1. Do nothing ---
This is always an option that should be considered.

--- 2. Ask your bank to lower your payment
This is unlikely to be successful.

3. Sell and pay the shortfall

4. Try to sell on a short sale

5. Let it foreclose*

*NOTE: I am giving you objective advice of your options. It would be inappropriate to color my advice by any moral judgments as to whether you should let your property foreclose.


Investing or Financing Question


"My wife and I want to buy a little house as an investment. We found one we both like, but it’s on a busy street. What do you think about buying a home on a busy street?"

***ANSWER:
Two questions come to mind: 1) how does it impact rent, and 2) how does it impact resale value?

RENT:

I’ve found rents to be impacted minimally by being on a busy street. Perhaps 5%.

An added bonus is that it’s easy to generate interest just by putting up a sign. That helps you rent it quicker, which puts more rent in your pocket.

RESALE:

Prices of homes with “flaws” (i.e. no garage, fixer-uppers, busy streets) are impacted more during buyer’s markets. Homebuyers have more to choose from and avoid these homes, so the prices must be discounted more to sell.

During hot seller’s markets, people feel lucky just to find any available home, so prices for “flawed” homes have lower discounts.

So since your rents are minimally affected and we’re in a buyer’s market, it could be a good move to buy that house on a busy street.
