Hello and welcome to the latest issue. …Whatever your politics, we’ve witnessed a historic event this past week. …Got back from a 2-day conference with Fannie Mae this week in Dallas. They have some bright, capable, and creative people managing their foreclosure process. A big surprise was how much they care about and want to mitigate the effect on the homeowners, tenants, neighbors, and neighborhoods impacted by their foreclosures.

CRAIGSLIST WARNING #2: Landlords Beware!
Last week I warned you of crooks offering homes they don’t own for sale or rent on Craigslist, hoping to pocket deposit and rent checks from unsuspecting people. One of my staff put his rental property on CraigsList only to find a reverse swindle: bogus tenant inquiries from scammers trying to acquire bank account info allegedly to wire rental deposit money, but really to drain the landlord’s bank account. For your amusement, I’ve attached 3 of the emails. One even attached a “personal” photo…swiped off a Hawaiian model agency’s website!

There ARE Bargains Out There…
A bank has asked me to sell a condo for them. It sold for 276K in April of ’05. I evaluated it in May at just 110K. Now that the occupant has been evicted, I re-evaluated it last week at…75K! The value has fallen a shocking 73% from 276K to 75K in just 3 1/2 years!

True Story: What’s The Payment On A $750M Home?
Russian Billionaire Roman Abramovich has reportedly paid $750M for a castle estate on Cote d’ Azur in the French Riviera. The home was originally built for King Leopold of Belgium to house his…uhh… mistresses. The $750M is a new world record for a private home, surpassing the $114M price tag for a London mansion paid by Indian steel magnate Laskhmi Mittal—chump change by comparison.

In case you were wondering, if you could get a 20% down loan on the home (you can’t) at 7%, the payment would be a tidy $3,991,815/month…plus property taxes and insurance.

$7500 Tax Credit Available For Many Homebuyers
First time home buyers get a tax credit up to $7,500 for buying a principal residence between 4/8/08 and 7/1/09. You must not have owned a home in the U.S. in the previous three years. Highlights:

  • First time homebuyers who purchase a principal residence between 4-9-08 and 7-1-09 qualify for the tax credit. (It’s retroactive if you’ve already closed.)

  • The maximum credit is $7500 OR 10% of the purchase price if less than a $75,000 sales price.
  • If you purchase the home in 2009, you can elect to amend 2008 tax returns and claim the tax credit.
  • The tax credit is later “Recaptured” by the IRS, so it’s really an interest-free loan paid back evenly over a 15-year time period. For instance, a $7500 “credit” is paid back at $500 per year. Homebuyers skip a year before payments start.
  • Consult your account to verify.

In summary, this is basically a tax-free, interest-free loan. If you are a first-time homebuyer thinking of buying a home, call us at (858)457-KENT to take advantage of this tax credit.

Top 10 Worst U.S. Metros For Foreclosures, Q3 2008
Florida, California, Nevada, and Arizona have the bulk of U.S. foreclosures. Of the top 20 metro regions with the highest foreclosure %, only Detroit and Atlanta are outside these states. Here are the top 10 metros as ranked by % of homes in foreclosure:

How Times Have Changed Dept.
Rates are in the 6%-7% range and some people are complaining. One of my preferred lenders told me he remembers that in the mid-1980’s when rates dropped below 13%, there was actually a refinance craze.

HomeBUYING Question


"How long does a homebuyer have to inspect a home?"

***ANSWER:
The time period is set by negotiation, but typically you’ll have 7 to 17 days to do all your inspections and investigations. There are a few bank/sellers out there that want you to inspect BEFORE you make your offer.


HomeSELLING Question


"If the Buyer has discretion to release all or a portion of a deposit to the Seller in the event the buyer cancels without cause, how is the Seller protected? It seems the Buyer has all the power in this situation--that doesn't seem right."

***ANSWER:
The escrow company can release a buyer's deposit to the seller or back to the buyer only with mutual instructions from the buyer and seller, or a court or arbitration order.

So if the buyer cancels w/o the right to do so, the escrow company cannot automatically give it to you or return it to the buyer. They must wait until the buyer and seller agree and instruct them, or until they receive a court or arbitration order.


Investing or Financing Question


"I heard that if you buy a foreclosure that the bank puts some onerous restriction on your ability to sell it for a profit. Do you know anything about that?"

***ANSWER:
The only “bank” that I know that does that is Fannie Mae. But it’s not onerous at all.

If you buy a Fannie Mae property as an investment, they place a deed restriction that for 3 months after closing, you cannot sell or refinance it for more than 120% of the price you paid.

After 3 months, you can do anything you want.

So it may restrict you if your plan is to fix and flip immediately. But otherwise it shouldn’t be an issue.
