Welcome to this week’s newsletter, where I go out on a limb and give you my predictions for our real estate market. …Thank you, Sandy P. for referring me and forwarding this newsletter to friends. …Have you noticed how incredibly low interest rates are now? Most fixed rates are in the 5-5.75% range.

My 2009 San Diego Real Estate Forecast
Despite remaining challenges, we’ve apparently stepped back from the brink of total national economic meltdown. So what does 2009 have in store for San Diego real estate? We have many varied and competing forces at play:

  • Foreclosure numbers are way down, due somewhat to CA Senate Bill 1137 forcing a 30-90 day hiccup in foreclosures. (It requires lenders, before they can foreclose, to contact homeowners to try to help them keep their homes.)
  • Murmurs of new state or fed “foreclosure moratoriums” that, while helping a few, would prolong the downturn
  • Continuing adjustable mortgage rate resets
  • Lenders more willing to help borrowers save their homes
  • A slowing local, national, and global economy
  • San Diego’s market fell first and hardest in the U.S.; some entire zip codes lost over 50%(!) of their value
  • Talk the feds directly bailing out distressed homeowners by lowering rates &/or principal balances (both doubtful)
  • Lenders delaying foreclosures in the unlikely hope the feds will bail them out by buying bad mortgages from them
  • Locally, investors buying bargain homes in droves. Many pay cash, perhaps w/ money pulled from the stock market
  • The mass psychology is gradually shifting FROM, “Why buy now when homes will be much cheaper later,” TO “Maybe I should one of the great deals I’m seeing while they’re this cheap.”

My prediction / guess / crystal ball gazing:

Drum roll please… I believe our market will hit bottom and stabilize some time in 2009.

Why?

Two sides of the same coin: Prices in much of San Diego are getting so cheap…

A) It’s possible to invest in a house or condo and actually get a positive cash flow.

B) For many people, buying and owning now costs little more than renting (and is often cheaper!), especially after tax deductions for mortgage interest and property taxes. And for others, it’s only a small increase to buy.

What should you do if you’re considering buying a home?

What you’ve heard on the news lately about the stock market applies to the real estate market too: even the experts can’t time markets perfectly.

So, if you do buy in the next few months, you’ll likely be buying at or near the bottom.

Disclaimer: I have an economics degree from UCLA, but I’m no economist. The above is merely my opinion.

Top 10 Best U.S. Cities To Work And Live
Human Capital Institute conducted a survey this past summer on America's favorite and least favorite cities to work and live. Respondents were asked about 40 large cities: "Imagine you were offered your dream job that required you to relocate. Which region in the following list would you be most likely to choose? … and which city region … would you be least likely to choose?" Interestingly, several cities made BOTH lists. Here are the results, along with the % of workers who’d like to move there:
1 11% New York (Also the #1 worst)
2 11% San Diego *  
3 9% San Francisco  
4 8% Las Vegas (#7 worst)
5 8% Los Angeles (#3 worst)
6 8% Seattle  
7 7% Denver  
8 6% Phoenix  
9 6% Chicago (#5 worst)
10 6% Boston  

*Inexplicably, the survey weighed 1st-, 2nd-, and 3rd-place votes the same. San Diego got more 1st- and 2nd-place votes than New York, but we ranked behind them because New York’s abundance of 3rd-place votes gave it slightly more total votes. And if you factor in that New York was also voted the #1 worst, the result is clear: San Diego is the #1 place to work and live in the U.S. …But we knew that already, didn’t we?

HomeBUYING Question


"Hi Gary, I’m in escrow on a home but changed my mind and don’t want it. How do I get my deposit back?"

***ANSWER:
If you still have any contingencies left you can exercise, the seller must agree to release your deposit.

If your contingency periods have expired, you can still ask. Many homesellers would rather just give you back your deposit and move on. If the seller refuses, you might agree to split the deposit.

Of course, if you have no contingencies left and are just flat-out breaking the contract, by all rights you should lose your deposit. That’s the purpose of it in the first place: to insure your performance on the contract and compensate the seller if you default.

As to the mechanics of the release, once you’re several days into escrow, your deposit will be held by the escrow company. They can only release it to you (or the seller) with mutual instructions from both buyer and seller, or with a court or arbitration order.

So if the seller won’t sign a cancellation releasing your deposit, depending on your contract, your options are small claims court or mediation/arbitration.


HomeSELLING Question


"With the market the way it is and prices down, do you think it’s a good idea to wait until next summer to sell?"

***ANSWER:
This year, most people who called me about selling their homes weren’t thrilled with their property values. And many said they’d wait and just sell in 2009.

Their unspoken and unrealistic assumption was that in 2009, home values would somehow automatically reset to peak 2005 levels.

Though I do some market prognosticating above, I can’t tell you if values will be lower, higher, or about the same come summer.

But I can tell you there will obviously be no immediate re-boot to 2005 prices.


Investing or Financing Question


"Hi I’m an investor and I’d like to conserve as much cash as possible. What’s the least I can put down to buy a property?"

***ANSWER:
It depends on what kind of property you’re buying:

- Residential: house, condo, or 2-4 apartments (duplex, triplex, fourplex)
- Commercial: 5+ apartments or other commercial property

Residential:

You’re usually looking at a minimum 20-25% down payment as an investor. You also have loan and other closing costs of 2-4%, but can get the seller to pay them up to 2% of the purchase price. If you put down 30-35%, you’ll get a better loan. Over 35%, it’s won’t make a difference.

Commercial:

You’re looking at a whole new set of rules. Typically the down payment is the GREATER of 25% or whatever it takes for the property to carry itself and have a sufficient “debt coverage ratio”. (Debt coverage ratio is the ratio of net operating income to loan payments on the property.)
