Kelly S. from my office sent me this link about a White House replica house listed for sale in Atlanta for $9.8 million.

True Story: We Just Might Have What You Need In Stock
Some foreclosures are illegally stripped of kitchens, baths, fixtures, etc., by former owners or burglars. Recently one foreclosed home that had been stripped was sold by the bank. The new owner then located the former owner, who still had all the components he’d removed from the home. The old and new owners agreed upon a price and the old owner not only returned the items, but even installed them.

"What costs to the buyer and seller usually pay?"

***ANSWER:
Division of costs vary by geographic region. In San Diego, the buyer usually pays:

  1. Home inspection + any other inspections (except termite)
  2. ½ the escrow fee
  3. Lender’s policy of title insurance
  4. Notary & recording fees for loan documents
  5. All new loan charges (credit report, appraisal, points, etc.)
  6. Prorated loan interest
  7. Prorated property tax
  8. Prorated HOA fee
  9. Fire insurance for first year

***ANSWER:
In San Diego, the seller usually pays:

Short Sale:

  1. Termite inspection & Section 1 repairs
  2. Legally required retrofits: smoke detectors, water-heater straps, perhaps toilets
  3. ½ the escrow fee
  4. Owner’s policy of title insurance
  5. Real estate fee
  6. Notary & recording fees for grant deed
  7. County transfer tax
  8. Homeowner association document and transfer fees
  9. Pro-rated HOA dues
  10. Any loan fees required by seller to pay (VA)
  11. Homewarranty
  12. Property tax proration
  13. Balance of mortgages against the home
  14. Any loan prepayment penalty
  15. Pro-rated property taxes

Investing or Financing Question


"Hi Gary. I’d like to start investing in real estate and would rather use my retirement funds. Can I buy real estate using my IRA?"

***ANSWER:
Yes, and I’ve done it myself a couple of times.

You must have a self-directed retirement account with a company (aka “custodian”) that allows real estate IRAs.

Some basics are:

  • - You can buy any type of real estate: houses, condos, raw land, commercial properties, apartments, etc.
  • - You can buy a partial interest in a property, which means your IRA can partner with anyone, including yourself (be careful w/ bookkeeping if you partner w/ yourself.)

And you must follow the rules, including:

1. You or your business cannot occupy the property.

2. You cannot buy a property from yourself, your spouse, or certain family members.

3. You cannot sell a property to yourself, your spouse, or certain family members.

4. You can finance the property, but it must be “non-recourse”, meaning that the property is sole security and the lender cannot go after the IRA for any loss.

5. All income and expenses from the property flow into and out of your IRA, not you personally. (i.e. You can’t pay the bills from your personal account or receive the income.)

There are additional rules, so please consult your tax professional for more info. (By the way, if your tax pro says you can’t buy real estate in your IRA, tell them to check again or go find another tax pro.)
