…I heard that one local agent gets his short sale sellers
$2,000 to $20,000 at closing. When they get an offer, they tell
the buyer to decrease the offer and pay the difference in cash
to the seller (without letting the bank know what they are
doing). Great idea, except it’s called F-R-A-U-D for all
involved: buyer, seller, agent. So if an agent suggests this to
you, run! BTW, if you have a loan with Wachovia/World, they MAY
offer some assistance, give me a call and let me see what I can
do for you (above board!).

"How do you find out the property lines. Ask the seller
or the agent?" |

Answer:
They may be happy to offer you their opinion, but you who knows
if they’ll be right or wrong.
Unless they’ve seen a survey, they heard from someone
else…who may or may not be correct.
To know for sure, you can get a survey. That’s rarely done in
urban areas, but if you’re buying more rural, it makes more
sense.
Home Selling Question

"Is it legal for agents to represent both the buyer and
seller? How can the possibly do that?" |

Answer:
Great question. This “dual agency” is legal in California and
most states as long as it’s disclosed.
The downside is that some agents abuse the situation. For
example, the buyer or seller may tell the agent their bottom
line and the agent could reveal it to the other party.
Unfortunately, this happens all the time.
On the other hand, this can happen even when the agent only
represents one party. I can’t tell you how many times, by asking
the right questions, I get other agents to spill their guts
about what price their client wants to buy or sell for. (BTW,
it’s perfectly ethical for me to probe for this information.)
Back to dual agency…
You’d expect me to say this, but I would never abuse a
client’s trust. Nevertheless, to avoid even the appearance of
this, I typically will not represent both parties in a
transaction. If someone is interested in one of my listings,
they’ll work with another agent on my team.

Answer:
Of course, many agents will answer “yes” to that whatever the
market so they can make a sale. So rather than just answering
your question, let me tell you what I’m doing:
- In October I bought a condo in my IRA to be a rental.
- I just made an offer on a 3-unit rental property.
So you can see that indeed I do think it’s an excellent time
to invest in San Diego real estate.
