Home Buying Question

"I love your newsletter, thanks for sending it. A CNNMoney.com article said the smart way to buy foreclosures is to contact banks and get to know asset managers. I’ve tried without any luck. Am I wasting my time?"

Answer:
Yes

Except for tiny community banks, 99% of banks are huge institutions with set processes for selling their foreclosures.

Asset managers are shielded from and do not interact with the public. You’ll never get to talk with them, nor would you get any advance tips if you did.

The best way to buy foreclosures is to work with an agent who specializes in them.

Home Selling Question

"I want to sell a house I own that’s currently tenant occupied. What rules do I need to follow on giving my tenant notice to move?"

Answer:
If the tenant has been in for under a year, you can give 30 days notice to vacate IN WRITING and correctly delivered.

However, if they’ve been in for a year or more, you must give 60 days notice unless ALL the following are met, in which case you can give 30 days notice [Cal. Civ. Code 1946.1(d)]:

The home is a single unit (i.e. a house or condo, but not a duplex, triplex, etc.)

The owner is in contract to sell to a real purchaser for value.

Escrow has been opened.

What about you?

The buyer is a natural person(s).

Notice is given within 120 days after escrow is opened.

Notice was not previously given to the tenant

The buyer intends to live in the property for at least one full year.*****

I put the ***** because this is the key point: the buyer must intend to live in the home for at least a year. (I assume seller is not penalized if he acts in good faith and the buyer ends up not living there a full year.)

Note: this is CALIFORNIA law and may not apply to other states. And as this is a legal question, please confirm the above with an attorney.

Investing or Financing Question

"I'm going to be buying a home soon and I'm a member of the XXXXXXXX Credit Union. Should I go there to get my home loan or to my bank?"

Answer:
Credit unions are funny. Because they're non-profit, you get some curious results...

Occasionally, credit unions have slightly more favorable rates than other lenders. And at other times their rates are above market.

Other potential downsides to credit unions are that they offer fewer loan options, are less flexible, and can be slower than other lenders.

While you should explore all options, including your credit union, we advise our clients to talk to our preferred lender who has many loan options, more flexibility, and is much quicker than most.
