…A recent study reveals a staggering 14.3% of U.S. mortgages are behind. Since 50%+ homes have loans, if you stroll around the block in a typical neighborhood, you’ll likely walk by 1 or 2 homes where the owner is behind. So why aren’t there foreclosures on every street? See the next paragraph:

…Term of the week: “Extend and pretend.” Also called “kicking the can down the road.” This describes how banks are often holding off foreclosing for many months on borrowers who aren’t paying their mortgage. Why? Reasons include trying to help the borrower stay in the home as well as an effort to avoid showing the bad loan on their books.

New rules for FHA borrowers. Rising FHA loan defaults have dropped FHA’s cash reserves falling below required levels. To recover, FHA has instituted several changes to start in spring or summer, including:

Raising the up-front mortgage insurance premium from 1.75% to 2.25%.

Raising credit score requirements: Borrowers must have a minimum 580 FICO score to get a 3.5% down loan. Below 580 FICO score requires at least 10% down. (Minimal impact as it’s very hard to get a loan with a 580 FICO anyway.)

Lowering allowed seller closing cost credits from 6% to 3%.

Home Buying Question

"I don’t know what to do. We were supposed to close on a short sale this week, but I just found out the bank foreclosed on the home. We had a contract. How is this possible? I even called the seller’s agent and they say they can’t help me. What should I do?"

Answer:
Many short sale homes are in foreclosure. If the home is in escrow, banks will often delay foreclosure to allow for the escrow to close. It helps if you get the bank the short sale documents more than 3 weeks before the scheduled foreclosure sale.

In your case, it sounds like either the bank wouldn’t delay the foreclosure at all, or perhaps they’d already done so but weren’t willing to do it again.

(Option #1) If you really want the home, you or your agent can call the lender and see if they’ll complete the sale to you. It would take a lot of time and persistence to reach anyone that might help you. And at best you’ve got a 10% chance of this working.

(Option #2) An easier approach is for you or your agent to check the house weekly. Once vacant, the bank’s agent puts a window sign with their contract info. Tell that agent you want to be called when the bank prices the house and puts it on the market. It usually takes 2-12 weeks for the home to be cleaned up, (possibly) repaired, priced, and put on the market.

My best advice: Do option #2 and keep looking for another home. If you find another one you like, buy that one.

Home Selling Question

"Is now a good time to sell a home?"

Answer:
Prices are on the upswing, but here are three reasons I think it is a good time to sell (my guess of the odds of each in parentheses):

1. $6500/$8000 Homebuyer tax credit expires 4/30/10
Specifically, buyers must be in contract to buy a home by that date and close by 6/30/10. (Odds = 90%)

2. Rates going up 4/1/10?
The government says they’ll stop buying mortgage backed securities 3/31/10. This would decrease mortgage money supply, pushing up the price of money, meaning higher mortgage interest rates. Higher rates mean buyers can’t pay as much for homes. (Odds = 70%)

3. More foreclosures coming?
Most of my bank contacts say foreclosures will increase slightly to moderately in coming months. More and more people are behind on their mortgages and banks are figuring out who they can save and who they will foreclose on. (Odds = 60%)

None of these are 100% sure things. If you’re a gambling man or woman, you could wait and see. But if one or two do happen, it will impact the market.

Investing or Financing Question

"Hi Gary. My wife and I are way upside down on our home and behind on our payment. Our bank has suggested we apply for a loan modification. Do you think this is a good idea?"

Answer:
If you love your home and you’re not that far upside down and can make the lower payment, a mortgage modification is a great idea.

The downside to a loan modification and keeping the house is that you’re still trapped in an upside down home. It could take years for you to see daylight—meaning to have any equity at all. And if you’re going to lose your home anyway, better to take the credit lumps now and get it over with and start rebuilding your credit sooner
